Terms and Conditions for Pokédex Checklist

Welcome to Pokédex Checklist (the "Website"), located at https://www.pokedexchecklist.com/. By accessing or using the Website, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, please do not use the Website.

1. Acceptance of Terms

By using the Website, you agree to comply with and be legally bound by these Terms. These Terms govern your access to and use of the Website, including all features, content, and services provided by Pokédex Checklist.

2. Description of Service

Pokédex Checklist is a web application designed for Pokémon card collectors to track their collection of one card per Pokémon species in the National Pokédex (1025 species). The Website allows users to create and manage a checklist, sort by Pokédex number or name, search for Pokémon, view completion progress, share checklists via unique links, and export data as CSV files. The Website operates offline using browser LocalStorage and is built as a Progressive Web App (PWA) for mobile-friendly use.

The Website offers both free and premium features:
- Free users can access core checklist functionality with data stored locally on their device. Free accounts may mark up to 250 Pokémon species as captured; this limit may change from time to time. Existing progress above the limit is retained, but new captures beyond the limit require Premium.
- Premium users can track all 1,025 species without a cap, create accounts, sign in via Google OAuth, Discord OAuth, or email magic link, save their progress to the cloud for syncing across devices, and customize their language preferences for Pokémon names.
- Logged-in users (free and premium) can view a Leaderboard that ranks users by their Pokédex collection progress, including Top 3 podiums for overall captures, completion percentage, longest collection journey (days between trainer start date and last cloud update), each generation (Gen 1–9), and each Pokémon type (18 types; dual-type species count toward each type), plus an overall ranked table. By default, the Leaderboard protects privacy: it shows only a partially anonymized display name (for example, the first two characters followed by asterisks), a generic placeholder instead of a profile picture, collection count and completion percentage, trainer start date, and last progress update. Email addresses are never shown on the Leaderboard. You may optionally enable leaderboard profile sharing in your account settings; if you do, your full display name and profile picture (such as from Google sign-in) may be shown to other logged-in users on the Leaderboard. You can turn this off at any time in account settings.
- Premium users who complete all 1,025 National Dex species on their main My Pokédex checklist (cloud sync) may earn permanent Living Dex Champion status after a short verification period. Champions receive a worldwide finisher number and may appear on the public Hall of Fame and shareable trainer certificate pages with the same anonymization and profile-sharing rules as the Leaderboard. Champion status, once confirmed, is permanent even if checklist progress later changes. Extra challenge binders do not count toward Hall of Fame eligibility.

3. User Accounts and Authentication

3.1. Account Creation: You may create an account by signing in with Google OAuth, Discord OAuth, or a magic-link email. By creating an account, you agree to provide accurate, current, and complete information during the registration process.
3.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3. Account Termination: You may terminate your account at any time by contacting us at support@pokedexchecklist.com. We reserve the right to suspend or terminate accounts that violate these Terms.
3.4. Third-Party Authentication: When you sign in using Google OAuth or Discord OAuth, you are subject to that provider's Terms of Service and Privacy Policy. We are not responsible for third-party authentication services or any issues arising from their use.

4. Use of the Website

4.1. Permitted Use: You may use the Website solely for personal, non-commercial purposes to track your Pokémon card collection as intended by the app's functionality.
4.2. Prohibited Conduct: You agree not to:
4.2.1. Use the Website for any illegal, unauthorized, or commercial purposes.
4.2.2. Modify, reverse-engineer, or attempt to access the Website's source code or data.
4.2.3. Misuse, reproduce, or distribute the Website's content, including Pokémon data or sprites, beyond the sharing features provided (e.g., unique links or CSV exports).
4.2.4. Engage in any activity that disrupts, damages, or interferes with the Website's functionality or security.
4.2.5. Attempt to access premium features without a valid subscription.
4.3. Accountability: You are responsible for maintaining the confidentiality of any data stored locally on your device or in your cloud account, and for any shared links or exported files.
4.4. Data Storage: Free users' data is stored locally on their device. Premium users' data, including checklist progress and language preferences, is stored in the cloud and synced across devices. You are responsible for backing up your data and understand that we are not liable for data loss.

5. Intellectual Property

5.1. Website Content: The Website and its original content, design, and functionality are owned by Pokédex Checklist or its licensors and are protected by copyright, trademark, and other intellectual property laws.
5.2. Pokémon Content: All Pokémon-related content, including species names, IDs, and sprites, is owned by The Pokémon Company and its affiliates. The Website uses Pokémon data and sprites sourced from:
5.2.1. PokeAPI (https://pokeapi.co/), a public API, under its terms of use.
5.2.2. Bulbapedia (https://bulbapedia.bulbagarden.net/), where applicable, in accordance with its terms of use.
5.3. Use of Pokémon content on the Website is subject to the terms and conditions of these sources and The Pokémon Company. You may not reproduce, distribute, or use Pokémon content outside the functionality provided by the Website.
5.4. Attribution: Pokémon data and sprites are provided by PokeAPI, with select data sourced from Bulbapedia, as applicable. Pokédex Checklist acknowledges and complies with the terms of these sources.

6. Third-Party Content and Services

6.1. The Website uses data and sprites from PokeAPI and, where applicable, Bulbapedia. These third-party sources are not controlled by Pokédex Checklist. We are not responsible for their content, availability, or accuracy. Your use of third-party content is subject to their respective terms and policies.
6.2. The Website uses Google OAuth and Discord OAuth for authentication. By signing in with those providers, you agree to each provider's Terms of Service and Privacy Policy. We are not responsible for third-party authentication services or any issues arising from their use.
6.3. The Website uses Supabase for cloud data storage and synchronization. Your data stored in Supabase is subject to Supabase's Terms of Service and Privacy Policy. We are not responsible for Supabase's services or any issues arising from their use.
6.4. The Website uses Google Analytics for website analytics. Use of analytics cookies is described in our Privacy Policy (https://www.pokedexchecklist.com/privacy-policy#cookies). Visitors in the EEA, United Kingdom, and Switzerland can accept or reject analytics cookies through the cookie consent banner, and can change that choice later via the Cookie preferences link in the footer.

7. Limitation of Liability
7.1. No Warranty: The Website is provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or availability.
7.2. Liability: To the fullest extent permitted by law, Pokédex Checklist, its operators, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Website, including but not limited to data loss, device issues, cloud synchronization failures, or inaccuracies in the Pokémon data provided.
7.3. Data Storage: Free users' data is stored locally using LocalStorage. Premium users' data is stored in the cloud. You are responsible for ensuring your device is compatible and secure. Pokédex Checklist is not liable for data loss due to device failure, user error, cloud service outages, or synchronization issues.
7.4. Cloud Services: While we strive to maintain reliable cloud storage and synchronization services, we do not guarantee uninterrupted access or that your data will be available at all times. We are not liable for any loss of data or service interruptions related to third-party cloud services.

8. Premium Features and Subscriptions

8.1. Premium Features: Certain features, including cloud saving, cross-device synchronization, and language preferences, require a paid subscription. Access to premium features is granted upon successful payment and subscription activation.
8.2. Subscription Terms: Premium is offered as a monthly subscription and/or a one-time lifetime purchase, as shown on the Premium page at the time of purchase. Monthly subscriptions automatically renew unless cancelled. You may cancel your subscription at any time through your account settings or by contacting support@pokedexchecklist.com. Existing subscribers on a previously offered yearly plan retain that plan until it renews or is cancelled according to Stripe billing. If a renewal payment fails, Stripe may retry your card using its Smart Retries settings; Premium access may remain active during that retry period until the subscription is cancelled or payment succeeds. We may email you when a payment fails so you can update your payment method in the billing portal.
8.3. Refunds: If you are not satisfied with your Premium purchase, you may request a full refund within 3 days of the purchase date by contacting support@pokedexchecklist.com. Refund requests are processed through our payment processor (Stripe) and are subject to applicable law.
8.3.1. Lifetime Premium: Refunds are available only within 3 days of purchase. After that period, lifetime purchases are non-refundable.
8.3.2. Subscription Premium (monthly or yearly): Refunds are available within 3 days of the initial subscription purchase or any renewal charge. After 3 days from a given charge, that billing period is non-refundable. You may cancel your subscription at any time through your account settings or by contacting support@pokedexchecklist.com; cancellation takes effect at the end of the current billing period, you retain Premium access until then, and you will not be charged for subsequent periods.
8.4. Marketing Communications: By creating an account on the Website, you agree that we may send you occasional marketing and promotional emails about Pokédex Checklist, including product updates, special offers, and premium subscription opportunities. You may opt out of marketing emails at any time by using the unsubscribe link included in each marketing email or by updating your preferences in your account settings. Opting out of marketing emails does not affect transactional or service-related emails (such as magic sign-in links, purchase confirmations, or essential account notices).

9. Sidebar Advertising

9.1. The Website offers paid sidebar advertisement slots. Advertisers may purchase slots without creating a user account. Pricing, duration, and volume discounts are shown on the Advertise page at the time of purchase.
9.2. Payment for advertisements is processed by Stripe. After a successful purchase, advertisers must submit shop details (such as shop name, location, description, website URL, and image URL) to activate the advertisement.
9.3. Submitted advertisements are displayed publicly on the Website (sidebar on desktop and carousel on mobile). We may decline, modify, or remove advertisements that violate these Terms, are misleading, or are otherwise inappropriate.
9.4. Refunds for advertisement purchases may be requested within 3 days of purchase by contacting support@pokedexchecklist.com, subject to applicable law. Contact support@pokedexchecklist.com for other advertisement-related inquiries.

10. Updates to Terms

Pokédex Checklist reserves the right to modify these Terms at any time. Updates will be communicated to users via email to the address associated with their account (if provided) or through notifications on the Website. Continued use of the Website after updates constitutes acceptance of the revised Terms.

11. Termination

11.1. User Termination: You may terminate your account at any time by contacting us at support@pokedexchecklist.com. Upon termination, your account data will be deleted in accordance with our Privacy Policy.
11.2. Service Termination: Pokédex Checklist may suspend or terminate your access to the Website at its sole discretion, without notice, for conduct that violates these Terms or is harmful to the Website or its users.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

14. Miscellaneous

14.1. Entire Agreement: These Terms, together with the Privacy Policy (available at https://www.pokedexchecklist.com/privacy-policy), constitute the entire agreement between you and Pokédex Checklist regarding the use of the Website.
14.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
